Patrick L. Premises Liability – 2024 NG&A worked with civil engineering experts to obtain summary judgment in a premises liability case by demonstrating that the alleged dangerous condition was not actionable as a matter of law. Through exacting legal drafting and compelling oral argument before the motion court, NG&A saved its client significant fees by resolving litigation before trial in Kings County, a jurisdiction where summary judgment is notoriously difficult to obtain.
Frivolous Litigation (Sanctions) – 2024 Faced with a series of claims of dubious merit, NG&A pursued and obtained an award of summary judgment for its client together with sanctions against Plaintiff’s counsel for frivolous litigation. The rare outcome came about due to NG&A’s impeccable presentation of the facts demonstrating its client’s freedom from liability, as well as Plaintiff’s counsel’s well-documented refusal to discontinue litigation in the hopes of obtaining a settlement contribution despite the absence of any wrongdoing.
Employment Law - 2023 When a client was faced with a series of unfair accusations of employment law violations, NG&A effectively avoided class certification while negotiating a favorable resolution with the purported representative plaintiffs.
Personal Injury - 2023, 2024 Following a jury trial wherein the Court issued an improper and confusing jury charge over objection, NG&A successfully moved the trial judge to vacate the jury’s verdict and render judgment notwithstanding in favor of our client, finding that no reasonable jury could have found against the Defendant but for the erroneous charge. Plaintiff appealed from that ruling, and NG&A successfully defended it on appeal, where the finding of dismissal was affirmed by the Appellate Division, Second Department.
Personal Injury – 2022 NG&A obtained a highly favorable settlement for a client who slipped and fell while ice skating. In so doing, NG&A overcame the incredibly high burden of the doctrine of Assumption of the Risk, demonstrating that the condition that caused its client’s injuries was not open and obvious or the sort of normal, foreseeable risk inherent in the dangerous sport of ice skating.
